- Account
Activation and Setup
Decode Studios Ltd will setup your account with us once
we have received full payment for your order, and this payment has been
screened by PayPal for fraud prevention purposes.
In order to provide you with service, you must provide
us with the at least the mandatory information, as requested upon sign-up. If
we have reason to doubt the validity of the information which you provide to
us, your order may be flagged as fraud, and thus cancelled.
Decode Studios Ltd will endeavour
to fulfil your order within 12 hours of your full payment being received.
Whilst web hosting orders should be activated almost instantly, domain name
registrations will only be fulfilled after being checked for fraud.
Due to the complexity, Business
Contracts and Custom Development work will take longer, and we will keep you
informed at every stage of the process.
While we will make every effort to fulfil your order in
a timely manner, this cannot always be achieved. You agree to indemnify Decode
Studios Ltd.
- Acceptable Content
Policy
All services provided to you by Decode Studios Ltd may
only be used within the terms of this policy. Decode Studios Ltd does not allow
the following material to be hosted on, streamed to or contained upon its
servers:
- Copyrighted
material; of which you are neither licensee nor author;
- Material
which can classed as threatening or obscene;
- Internet
Relay Chat (IRC) bots;
- Proxy
or Anonymizer scripts;
- Warez
distribution systems;
- Pirated
software distribution systems;
- Hate
content;
- Hack
programs or archives;
- Material
which promotes or advertises illegal, or potentially illegal, activity;
- Adult
and pornographic content.
Please be aware that Decode Studios Ltd instigates a
zero-tolerance policy with regards to adult and pornographic content. Any
customer which has such content on any service provided to them will have such
services terminated, without warning or refund.
Any customer who has content on any service provided to
them which violates this policy will be issued with a warning, which should be
responded to within the timeframe outlined to them. This timeframe will be
dependent on the severity of the issue. Should a response not be solicited
within this timeframe, the services will be automatically suspended, pending
termination if no response is solicited within 7 days of the initial notice.
- Zero Tolerance Spam
Policy
Decode Studios Ltd will not tolerate, under any
circumstances, the sending of unsolicited e-mail, bulk emailing, or SPAM. It
must be clear that the recipient of any email sent by a user is either
expecting the email, or has warranted that you send them emails. Any customer,
who does not follow this policy, will have their services terminated, without
warning or refund.
Decode Studios Ltd reserves the right to require changes
or to disable as any necessary any web space, account, database or other
component which does not comply with this policy, at its sole discretion.
Decode Studios Ltd also reserves the right to make any such modifications in a
situation where an immediate response is required.
Any customer, who instigates spam, or unsolicited email,
will be liable for any damages caused as a result of failing to follow this
policy.
You agree to indemnify and hold harmless Decode Studios
Ltd for any claims resulting from failure to agree to this policy.
- Payment Information
You agree to supply appropriate and full payment for the
services which you receive from Decode Studios Ltd, in advance of the time
period during which such services will be provided to you. You agree that
until, and unless, you notify Decode Studios Ltd of your desire to cancel any
such services, as covered by further policies in this document, such services
will be requested on a recurring basis.
Decode Studios Ltd will endeavour to generate invoices
at least 7 days from the due date of the package. Payment can be made any time
while the invoice is active, and the payment will only apply to the time period
starting from the date when the invoice is due, rather when the invoice is paid.
Decode Studios Ltd reserves the right to change the
prices of certain packages or accounts at any time, without any notification,
should this be deemed necessary.
Decode Studios Ltd reserves the right to suspend any Business
account whose services have not been paid after 30 days from the payment due
date.
We also reserve the right to suspend and Personal
Account whose services have not been paid for 7 days after the payment due
date.
- Late
Fees
Any invoice which is not paid within 35 days from the payment
due date will be liable to pay a 10% late charge, on the total amount due on
the invoice. This late charge will become included within the invoice, to be
paid in full with it.
Late fees are not refundable, and cannot be transferred
to any other invoice other than the one to which they apply.
- Back-ups
and Data Loss
Decode Studios Ltd is not responsible for the files and
data residing on your account. Personal Users agree to take full responsibility
for the files and data transferred and to maintain any backups as you see fit
and appropriate. While Decode Studios Ltd may take server backups, these should
not be relied upon for restoration in the event of data loss (that is, in the
event where files and data become unavailable, corrupt or are deleted). If required, Decode Studios Ltd may be able to
provision a backup from our weekly backup routine. A nominal charge will be
applied for this service, as we see appropriate. For Business contracts, Decode
Studios will provide backup as stated in your plan and are not liable for any
loss of data outside of this service.
Decode Studios Ltd should be indemnified and held
harmless from any loss of business, sales or uptime arising as a result of
using our services.
- Force
Majeure
Decode Studios Ltd cannot be held liable for any failure
to provision or provide appropriately any services, where any such failure is
as a result of an Act of Nature (including flood, fire, earthquake, storm,
hurricane or other natural disaster), war, invasion, act of foreign enemies,
hostilities (whether war has been declared or not), civil war, rebellion,
revolution, insurrection, military or usurped power of confiscation, terrorist
activities, nationalism, government sanction, blockage, embargo, labour
dispute, strike, lockout or interruption or failure of electricity or server or
staff internet connectivity.
- Cancellations and
Refunds
Decode Studios Ltd require that account cancellation
requests be sent at least 7 business days prior to the renewal date of the
account in question. All invoices and bills generated prior to the account
cancellation request must be paid.
Account cancellation will take place on the date of
renewal, and as such Decode Studios Ltd will not be liable for any refund or
credit.
Decode Studios Ltd reserves the right to cancel any
account, without warning or refund. Refunds will be given only as we see fit.
- Resource
Usage
Customers may not:
- Use
25% or more of system resources for longer than 90 seconds in a given 24
hour period.
- Run
any type of interactive real-time chat application which uses more than
15% of system resources at any given time.
- Run
standalone, unattended server-side processes at any given time. This
includes all daemons, such as IRCD.
- Run
any software which interfaces with an Internet Relay Chat (IRC) network.
Any customer which fails to adhere to this policy will
have their account suspended immediately, and any related processes killed.
- Bandwidth and Disk Space
Allocations
You are allocated monthly bandwidth and disk space
quotas. These quotas vary depending on the package which you have selected for
your account. Your account will be automatically blocked from going over any
limits, and you must contact Support to request more resources, for your
account to continue to function
This is subject to additional charges, which will be at
the sole discretion of Decode Studios Ltd.
You agree to indemnify and hold harmless Decode Studios
Ltd for any claims arising from the failure to have appropriate usage
capacities.
- Price
Change
The amount which you pay for hosting will not increase
from the date of purchase, unless you elect to have your package changed or
modified. We reserve the right to increase the amount of resources given to
plans or packages at any time, and to change the prices of any such plans or
packages.
- Special
Offers
Decode Studios Ltd reserves the right to add or remove
any special offer without warning at any given time.
- Support
Policy
Decode Studios Ltd will provide priority technical
support services to the customer, for services which are provided to them under
this agreement. Technical support services are available for the vast majority
of the day.
Decode Studios Ltd will make every effort to respond to
tickets within 3-12 hours, and we guarantee to respond to tickets within 24
hours of them being submitted. Should we fail to reply within 24 hours, Decode
Studios Ltd will offer the customer a selection of free add-ons to their
service plan.
Decode Studios Ltd provides support service only via our
online ticketing system at https://billing.decodestudios.net/.
No other support services are valid, and if you are assisted out with our
ticketing system, you should be aware that we do not guarantee any level of
support service to you.
We provide support services solely for issues directly
related to the functioning of your account, under services which we explicitly
provide to you. We will not assist customers with coding, programming, or
third-party software. In all instances, you will be referred to this document,
and your ticket closed.
- Disclaimer
Decode Studios Ltd will not be responsible for any
damages of any kind that you or your business may suffer as a result of using
our services. This includes, but is not limited to; loss of data, interruptions
to service, loss of business. Decode Studios Ltd will make every effort to keep
service interruption to a minimum, as is within our control.
You agree to indemnify and hold harmless Decode Studios
Ltd for any such claims.
- Cease
Decode Studios Ltd reserves the right to cancel or
terminate any account at any time where we see fit.
- Modifications to the
Terms of Service agreement
Decode Studios Ltd reserve the right to revise or modify
its policies at any time, without notice, except where a significant departure
is made from the original policy, and the new policy, when all customers will
be notified of the changes within reason.
- Nominet Registrar Terms and Conditions
By registering a
domain name through Decode Studios Ltd, you also enter into a contract of
registration with Nominet UK on the following terms and conditions as set out
here: http://www.nominet.org.uk/nominet-terms.
This is a separate
contract to any arrangement you may have with us or any 3rd party
for the provision of internet services. In registering through Decode Studios
Ltd, you also agree to have read, understood and do accept the Terms and
Conditions of Nominet UK.
